Can anyone recommend sources of information or legal aid relating to signing up for MassHealth / Medicaid? Seeking someone with knowledge on the current system/requirements, to help a person with zero income but some assets renew their enrollment in the least-damaging way.
Pointers toward nonprofits that answer this kind of question, or anything similar, would be appreciated.

Somerville man loses another lawsuit over stuff posted about him online

A federal judge today dismissed a lawsuit by Jonathan Monsarrat over postings in a Somerville community forum, saying the forum's moderator did nothing wrong or defamatory when he moved the entire discussion group from a server owned by Russians to one based in the US.


Section 230 is pretty great, y'all. So is the Fair Use doctrine.

Does anyone know a good local lawyer who can handle things like estate planning, medical powers of attorney, etc., especially for people in non-traditional family structures? Doesn't have to be Davis proper, but preferably nearby and T-accessible or a close walk.

The owners of the Gorin Building at 255 Elm Street have sued the owners of Found, a used-clothing consignment shop that closed at the end of January.

The suit alleges that Found owes $21,981.42 in unpaid back rent, that they abandoned the property leaving it in "disarray", and that they broke their lease which obligates them to pay rent through the end of August 2017. ($9472.50/month through 8/31/16, then $9804.03/month through 8/31/17)

So far, this sounds like an ordinary business dispute, but the landlord also twice cites my January 28 post to DSLJ:

COUNT III: Fraudulent Transfer
20. Upon information and belief, the defendants are seeking to use the funds and assets of the defendant Found to start a new company or to establish Found in another location. (See Davis Square Live Journal, dated January 28, 2016, attached hereto as Exhibit "C")

and
COUNT V: Slander/Defamation - Fred Bennett
29. Upon information and belief, on or about January 28, 2016, while in the process of abandoning the Premises, defendant Fred Bennett told a third-party that the plaintiff was "a greedy jerk who jacked up the rent, and is not a good person." (See Exhibit C)

30. The statement by Bennett is factually untrue.

31. Additional comments on the community webpage attached as Exhibit C demonstrate that such defamatory words of defendant Fred Bennett held the plaintiff up to contempt, hatred, scorn, or ridicule or tended to impair his standing in the community, at least to his discredit in the minds of a considerable and respectable class in the community.


I became aware of this lawsuit when a representative from Safety Insurance Company came to my door at 12:55 pm on Tuesday afternoon, May 24. He wanted me to sign an affidavit stating that I made the DSLJ post cited above, and asked me some questions about the appearance of the person whom I quoted in that post. I declined to sign the affidavit, which was my right, but the Safety rep said that this may result in me being subpoenaed as a witness.

He told me that the owners of Found had cancelled their insurance policy the same day as my DSLJ post, and he was very interested in determining whether Fred Bennett had cancelled the policy before or after making the statement quoted above.

If anyone wants to follow along, the case number is 1681CV00413, Misujo Realty LLC vs Davis Square Consignment, LLC Doing Business as Found, Fred Bennett, Meredith Bennett, Defendants, and Eastern Bank NA, Trustee Defendant. The complaint was filed in Middlesex Superior Court which is located in Woburn. You can follow the status of the case by filling out this form, but the content of the filed documents is not online. So far, the defendants have not answered the complaint. Their deadline for doing so is June 15.

According to Somerville zoning laws, how many people can reside in a one-bedroom? I had assumed it was only two people, but I can't find anything on the city's website about it.

Recently, I received a letter in the mail from Neraj Tuli of Zone Smart Somerville (www.zonesmartsomerville.org).  The letter was urging me to oppose a provision in the proposed zoning changes which would prohibit occupancy of a house or unit by more than four unrelated adults regardless of the size of the house or unit or other mitigating factors.  Does anyone know anything about this?  I believe I am opposed to this provision, but would like to learn more.

Thanks to the Boston 2024 Olympic bid, I learned today that Somerville still has this law on the books, probably left over from the 1930s:

Sec. 8-186. - Marathons, walkathons and other endurance exhibitions.

No person shall conduct in any hall or other public place in the city any dancing exhibition or other form of public amusement such as a walkathon or marathon exhibition wherein the participants therein are permitted to engage in an endurance contest, or wherein persons engaged in such a contest continue to dance or walk or engage in said contest for more than four hours in any one day; nor shall any amusement or entertainment conducted in connection with or as a part of such dancing or walking contest be permitted after 12:00 midnight on any weekday except Saturday, on which day said walking or dancing contest or amusement or entertainment conducted in connection therewith on the premises or place of amusement shall cease at 11:45 p.m.

I don't expect this to affect the Olympic cycling events that are proposed for Somerville, since none of them are likely to last over four hours or continue past 11:45 pm.

As ant season is starting up, I wanted to get a head start and ask: Does anyone know anything about tenant law when it comes to being overridden by carpenter ants? I'm not actually foreseeing any problems this year, but it seems like a good thing to know and would've been useful in previous years.

I've been remiss in catching you all up on what happened:

I got a call from Jim Cassidy, the inspector for Cambridge Weights and Measures, last Monday, that he'd done a spot inspection of Star.

He didn't find anything amiss at the scanners[*], but armed with the evidence submitted by another [livejournal.com profile] davis_square denizen, he had a talk with management. Apparently they were aware of the discussion here ("We lost the element of surprise. There's something called, er, 'Universal Hub'?")

But he made it very clear that neither I nor anyone else should shy away from blogging about these things; after all, it turned up useful evidence.

He said he'd be keeping a close eye on them and would be spot checking them more in the future. He strongly encouraged all of us to call, email, or use the web form if we encounter any further scanner errors: he reminded me that his office relies on consumers to be their eyes and ears. So don't be shy about reporting it! He was very pleased and appreciative that so many folks got involved.

So that's where things are at.

[* He did find an out-of-order price check machine, which is not okay, and which management said they'd fix pronto. FYI price check machines are now a big deal, as they are a concession for the relaxing of certain price labeling laws: they don't have to put a little sticky label on everything if there are enough working price check machines.]

So, who else here has Star tried to rip off -- or succeed in ripping off?

Today when I dropped by, there was a circular advertising $1.79/lb for boneless chicken breasts and thighs. I got to the meat aisle, and sure enough there were packages of boneless skinless chicken breasts and packages of boneless skinless chicken thighs marked right on them, with those regular printed sale stickers: regular price, $2.89/lb, sale price $1.79/lb. So I picked up four.

They rang up at the register as $2.89/lb. When I objected, the cashier argued with me. She told me that if I had a problem, I had to take it to the Customer Service desk. Which, it being after 10pm, was closed. I insisted and she called over a more senior employee, who looked that the package, and agreed, yes, the sale price was $1.79. He agreed to refund me the amount charged, and then sell me the chicken at the correct price. After about 20 minutes of farting around and waiting for another cashier's register to become available (?!), he issued the refund and rang them through again.

And this time, they came up various prices from $3.11/lb to $3.97/lb. My bill, which should have been on the order of $15 was $29.98.

At this point, a still more senior employee came over and issued me another refund, and at this point, disgusted, I left without the chicken.

That sale ended today. It was a week-long sale. Now I'm wondering: how many people paid $2.89/lb for that chicken which was advertised and labeled $1.79/lb? $1.79/lb is a pretty good deal on boneless skinless chicken! That's probably why it was on the front of the circular, above the fold. How many people showed up specifically for that chicken at that price and were charged more, and didn't notice? Or didn't notice till they got home and decided they didn't have the time or energy to do anything about it?

So I figured I'd ask here. Did anybody else experience this?

Because this isn't the first time for me at that store, when I've bought meat on sale. And from something one of the staff said, I gather it's not the first time for a lot of people.

ETA: I'm surprised that the usually well-informed denizens of Davis Square are unfamiliar with the enforcement of this law. The above described behavior is actually quite seriously illegal, and there's an entire little branch of the government for dealing with enforcement of it. There's Comm of MA law M.G.L. Chapter 24, Section 184 B, C, D and E which covers this. Enforcement is left up to the individual towns. Each town has "Department of Weights and Measures" to do that.

The Porter Square Star Market is in Cambridge. Here is the web page for the City of Cambridge Weights and Measures Department. Even more pertinently, here's the complaint form. Note that "scanner errors" is on the pulldown list.

(Should this come up for you closer to home, here's Somerville's. They don't have a form, but they have a phone number and email address. Here's Medford's Weights and Measures Dept page. Medford has a form. Why doesn't Somerville have a form? Boston's Weights and Measures Dept. Arlington's "Sealer of Weights and Measures".)

I assure you, I filed a complaint before I posted this, and had a voice mail from the appropriate official before most of you saw and responded to this.

Here's the problem: because the sale ended at midnight, the inspector -- who told me he would be headed over there today -- can't reproduce the error. He might find that the same problem exists with some other item, but he can't prove that, all last week, Star was advertising one price then charging another.

So I turn to you: anybody have a receipt for the $2.89 price and an actual pack of the chicken, still in the packaging, still with the price label on, showing the $1.79 price?

Because it seems to me if we can come up with that, we have adequate legal proof (civil cases are to "preponderance of evidence" NOT "beyond a reasonable doubt"!) for a finding that Star defrauded all customers who bought that chicken.

And the fine is $100 per item.

This isn't merely unfortunate, or frustrating. It's illegal and it's unconscionable. There are people in our community -- frankly, the ones most likely to be drawn in by a sale, and most likely to buy in quantity when offered a sale! -- who can't afford an additional $10, or $20, or $50. That comes right out their food budget.

It's infuriating to me that the Porter Square Star's little accidentally-on-purpose fraud habit is so well known to the community that a lot of us have stopped shopping there. They are literally getting away with theft, by spreading it out among a large number of people, so no one person is out so much that they're motivated to make much of a stink.

Well I'm planning on making a stink about this. I'd ask you to join me in making as much stink as you can.

Yes, try to get your money back if you can, try to catch the errors before they happen, complain to management, and get your free items if you can.

But even if they DO make it right with you: REPORT THEM. EVERY SINGLE TIME. Because if the scanner is coming up with the wrong price, that means everyone behind you in line is going to get ripped off too, and not all those people will be in a position -- of time, of energy, of liberty, of knowing their rights -- to demand satisfaction before they leave the store, even if they notice. Which Star is banking that they won't.

This has to end.

The Weights and Measures Departments rely on consumer complaints to drive enforcement. So please -- please! -- file complaints every single time you catch Star's scanners doing this.

Hi all,

I got a traffic ticket in the mail from the Somerville Police that I should obviously fight.
(this is not a parking ticket)

Does anyone have any suggestions for traffic attorneys used to fighting somerville.

EDIT: I see that people have contested tickets on their own with mixed success, so I'm seeking an attorney.

They differ slightly. One allows mailing of tickets, establishes default fine amounts if a city passes none, and has a $25 ticket limit ($100 for bus stops), the other a $50 ticket limit ($100 for bus stops and fire hydrants). One has some extra requirements specific to Boston and Cambridge.

So, how is it that the Somerville Traffic Commission has multiple $100 and $200 fines on their books?

(EDIT: I've struck out the fines that comments below have found legal justification for)

Obstructing Posted Fire Lane $100 89 MGL 7A

I expect that there are further statutes allowing some of these, specifically. I would not be surprised to find a state statute allowing exorbitant fines for handicapped parking violations. However, I can't find any of them. Help?

Sorry for going a mile afield. If there's a decent community forum/site for Medford (or south Medford) I would appreciate if someone could point me in that direction. I just moved from Teele Sq to about a mile north of Davis Sq in Medford.

I just did a google search of this community and while I found discussions on other courts, I didn't find anything for this one:

I was summoned to jury duty in Woburn. I don't drive. Does using only public transportation qualify me for a hardship transfer to another court in Middlesex County? If so, which ones are the most T-accessible? My card lists Malden, Lowell, Marlborough, Somerville, and Ayer as hardship transfer possibilities.

If not, it looks like the best bet is the 134 bus, which leaves from Wellington Station. It wouldn't be fun to get there (I live in Davis) but it would be possible.
